August 2008 They Unifund claim I had an account with Citibank (original amount was for 3400.00) and got a default judgment against me, which I knew nothing about until we went to refinance (May 2008) our house and a lien (sometime in 2006) was put on our house as well. None of this shows on any of my credit reports. I sent a sworn denial affidavit to Glasser and Glasser (certified mail) and provided the courts with this information as well and then Unifund/ Glasser & Glasser in Richmond, VA had 5300.00 in my checking account froze until the court date of September. Not one time did I ever receive any information from Unifund or Glasser & Glasser, the only way I obtained any information was in when we tried to refinance and the refinance company sent me the information. The default judgment was filed in 2003 I was never served papers of any sort about any court dates or anything. I have all 3 credit reports and I have not found any account on any new or old credit report showing I ever had an account with Citibank.
May 2008 SOOOOO FRUSTRATED!!!!!! I have a
debt on my credit report for Unifund. I sent them a letter
disputing this alleged debt on via certified mail... I got a
letter back from them stating that they received my letter
and will get back to me once they got the information..
I replied to that letter with the same letter I sent the
first time stating that I receive their letter and I am
disputing this alleged debt and I request validation within
30 days.
I never got a response from them
after this so I sent another letter stating that their 30
days is up and they have 20 days to remove this alleged debt
off of my credit report before I file a law suit against
them.... I also sent this letter certified mail...
I received a letter today - a computerized copy of a
statement from the original creditor... It is only a
statement two pages long.. They didn't not provide me the
original signed paperwork or proof that they are able to
legally collect in the state of Florida... Plus their 30 day
grace period to provide the information pass a long time
ago...
I know they are not licensed to collect in the state of
Florida because I looked it up on my states website... They
did not provide the proper documentation to prove this
alleged debt is indeed mine...
What do I do now? This is very frustrating...

May 2008 I am so frustrated!! I am not sure
where to go from here. I have been fighting this since
October. I have sent certified letters to the agency. After
I did that I still heard from a attorney of theirs and THEY
HAVE NEVER EVER VALIDATED THE DEBT. It disappeared off of my
credit reports. Well low and behold its back on there!! I
contacted the credit bureau again and it's on there again,
as a new account and they stated they verified it again.
How is it a credit company can do what ever it wants??? And
I can't get any help!!??? Validate the Debt or LEAVE ME
ALONE!! I have a file on this 2 inches thick of trying to
get them to do the right thing...
It's no wonder people just give up on trying to get this
fixed!! I have filed a complaint with the FTC and still
nothing! Have no Idea where to go from here!! I do not have
the money for an attorney and I'm sure they will take
everyone off and change it again. I appreciate all your help
guess I'm just going to have to wait until time is up and
they take if off my credit report in 2009.

2007 Found out after I filed my answers and affirmative defenses that ("Unifraud") Unifund is not even licensed in Florida as a debt collector though they allege in the complaint that they are. Followed the paper trail from Tallahassee to Ohio. Plaintiff in suit is Unifund CCR Partners, G.P... neither that subsidiary nor the corporation who owns them Credit Card Receivables Fund Incorporated is registered in the state for debt collecting and there status as a business entity is inactive. Thank heavens I denied and asserted an affirmative defense as such.. I had each department in Tallahassee check anything beginning with Unifund and Credit Card Receivables Fund for registration and nothing.. nada.. zip.. Obtained written documentation from Office of Financial Regulation and paid for certificates of status from Division of Corporations. They just think they can "sham" people.. Not validating, not registered as collection agency, inactive business entity and they don't even follow the rules of civil procedure for the state in their complaint. Did not attach a thing.. Need to amend complaint and assert sham pleading.
2007 Well I'm glad I stumbled on this website. The bottom feeder Unifund, made changes on my credit report so I looked them up and found this site. After doing some searching I find that they bought the account from another collection agency. NOT FROM THE ORIGINAL CREDITOR. So I have written a validation letter and sending it Registered or Certified. I have also sent a letter to both credit bureaus that Unifund put on that I have an open account with and I will be waiting for their response. I really really have a hard time with the fact that these credit collection companies can put anything thing they want on my credit report. In FACT I'M FURIOUS!! This account that reported on was charged off due to a divorce from the original creditor. 5 yrs. later in walks this credit agency, so I have not only the original creditor on my report... This company puts another mark on my report. It's almost like a double whammy!! But I'm not going to let them get away with it!! Waiting patiently for a reply or response from the bottom feeder. Thank You So Much for your help. This has actually been a real great learning experience.
2007 Well I am glad I found your website. It may prove helpful later on with any legal assistance. Unifund recently sent me a letter asking for in one letter $3852.34 dollars and another letter wanting $15.797.00 dollars! I had 30 days to respond in writing if I disputed this amount. I just sent the letter certified disputing the amount and asking for verification. I also wrote them that I suspected it was part of an Identity theft case that I had reported to the police in 2005. I did a credit check and found the amount reported under Unifund to Equifax. One amount was $3762.00 and the other was for $9178.00 in collections. Now, how in the heck did Unifund come up with $3852.34 and $15.797.00 in their letters to me. This is the first time that I have been made aware of this debt through this collection agency. This appears to be a rip-off of some sort. I will see what battle awaits me. Its enough that I already put local thieves in jail for petty crimes as a police detective. Now this! (Rip-off or not, we believe these guys are dangerous. Watch carefully for their responses.)
2007 I noticed on my credit report under
negative items, a listing for Unifund with an open date of
8/2007. I disputed it on my credit report and sent the debt
validation letter, certified, return receipt as Mr. Hibbs
instructs. I got an email from the credit reporting agency
today that the Unifund account had been deleted. It took
less than 2 weeks.

2007 We went down to the courthouse and
picked up the pleadings in the lawsuit by UNIFRAUD against
us.
We also got copies of our credit reports and found some very
interesting entries!
First, UNIFRAUD'S pleadings ARE a joke. There is a claim for
breach of contract, but no contract or contract terms or
dates as a part of the complaint. The alleged seller of the
paper to UNIFRAUD was Chase Bank, who we contacted 2 years
ago to have them removed from our credit report, which they
did, with a letter to us indicating that they could find no
record on us, and apologized "for the inconvenience".
Yet on our credit report recently UNIFRAUD says its an open
account, and fraudulently reported to the credit agencies
that we had made a payment in May, 2006 (thus making it
appear as the account was "new" or not 180 days past DLA or
to preserve their Statute time???
Regardless, it was fraud. Thanks for all you do for the
defrauded consumer. Never thought I would end up being one!

typical of many we receive daily on this sham of a bottom
feeder, scavenger junk debt buyer. This is fraud, plain and
simple. The American consumer is realizing they can fight
back with legal actions against Unifraud. We encourage those
wronged by their bogus claims to contact us for assistance
and referral to attorneys who can assist them.
2007 I come to the conclusion that our
government ignores the outright violation of collection
laws. The Federal Trade Commission receives hundreds of
complaints on these mobster extortionist and they do
nothing. Case law is vague concerning debt validation is
anything the mobster chooses it to be. Often times they have
no documents other then name address and social security
number and phone. In yet these mobsters can lie, threaten
and commit document
fraud and the courts pat the good ole boy mobster lawyers on
the back and rubber stamp a judgment.
Bud you got pull. Please find out what the FTC has to say
about this company and the hundreds of complaints it
receives. The FTC needs to get to work and get Unifund
shutdown.
2007 I have researched them in 5 counties
in New York with there pals Sharinn and Lipshie
99.9% WERE DEFAULTS HUM ???? BECAUSE OF Bogus affidavits of
service and not doing there job legally I think when this
happens the Y unifund and Sand L violate our civil rights
for due process-- by the way i have them in federal court

sharinn and lipshie failed to respond so i filed for default
judgment against them will find out monday if unifraud files
in time
2007 Thought I would let people know that Unifund is know sending out fake prize mailers with the heading as "Electronic Telegram Xpress" with a phone number 1-800-364-0740. If you receive something like this don't bother to call it.
2007 Unifund sent a letter saying I owed for a Citi card. I sent a request for validation via certified mail. No validation after 30 days. I am in the process of having a lawyer contact the credit reporting agencies to have all references to Unifund or this alleged debt removed from my reports. Here is something interesting, I checked the court records here for all cases involving Unifund. Not one person who filed a response and showed up for court lost! They only win when they get a default judgment! Dispute everything they send you and show up if they sue, you will win! Who else would like to research their local records and report back?
2007 Unifund filed a judgment against me when I was on vacation in Florida. I was never served any summons to go to court. They had my bank accounts froze. I owed citicard 4,500 and could not make payments do to a separation with the mother of my children. When I contacted citicard to make payments they said it was sent to a collection agency. that was in 2004. Unifund got a judgment against me for 10,000.I had my attorney contact there attorney .thier attorney said they would accept 6,200.that was two days ago, now I have the funds and they say they will only accept 9,000. Now I have to file bankruptcy. I am probably going to lose my business. I cant even pay my child support now.
2007 I just received in the mail a letter
from The Law Offices of Laurence Hecker, located in New
Jersey. It was in response to my letter to him requesting
Validation of Debt for a First USA account that is 6 years
old and way past SOL. It had an attachment, that was an
Affidavit from a Kim Kenney at UNIFUND CCR Partners,
Cincinnati, OH. It is an exact replica of the affidavit
posted on your website for UNIFUND.
I find this quite amusing. I sent another letter by
certified mail to Laurence Hecker's office, stating that he
has failed to properly validate my debt in accordance with
the Fair Debt Collection Practices Act. The law is invoked
and the account remains in dispute. The first collection
agency to try to collect from me on this account was
Alliance One. They failed to verify my request of the debt.
The next collection agency to try to collect on this account
was Lake Valley Retrievals, San Diego, CA. They failed to
verify the debt back in 2003 and now Laurence Hecker is
trying to collect on this debt. I don't understand where
UNIFUND comes into the picture. I have never received any
notices of collection from them or calls. Never heard from
them ever. Just thought I would pass this information
along.

2007 Unifund now has a website (www.unifund.com). I had a debt which had been resolved during a bankruptcy (never been there before and we won't be again). All of a sudden the company (Unifund) shows up on our credit report from Equifax. I called Equifax and was instructed to go on-line and file a dispute (on the Equifax site) which we did. Unifund responded to Equifax indicating simply the debt was ours. Equifax indicated we would need to call Unifund to resolve the problem. Doing so led us in a computer menu circle (unless you want to pay the amount indicated). We were told in the menu to go to their website to resolve the problem. It looks like they want additional information from us to update their records (current employer, current telephone, etc). We stopped before we made another mistake.
Well, I received a notice from a
"real" law firm in my home state stating that they were
representing Unifund. They were trying to collect on a
behalf of Unifund. I'm not stating the name of the law firm
at this time because after sending the following letter
after initial dispute of the debt, I've not heard from them
at all. I want to thank you Bud for your informative website
for dealing with creditors and the NACA lawyer that I also
received some great advice from. The following is an excerpt
from the letter I sent the law firm, I hope it helps others.

This letter is in response to your letter dated 09-12-2006
(copy enclosed) of the above referenced account. After
through review of the documents that you have presented to
me and after receiving legal councel, I want to point out
that in your firm’s initial contact with me dated 07-10-2006
(copy enclosed) concerning this alleged debt, your firm
stated that I owed $8,476.37. After receiving your second
letter dated 09-12-2006, with the documents that I requested
(copy enclosed)<this was copies of the statements and a
breakdown of all the charges>, the amount stated in that
information concerning the alleged debt amount is only
$6,165.30 (copy enclosed). I also want to point out that the
date of the last activity (payment) on this account was on
11-11-2001 (copy enclosed).
These facts are very clear in the information that your firm
has provided to me regarding the validity of this debt and
since this all your firm is providing as proof...
I do not believe I owe what you say I owe therefore I
dispute this debt. I have been advised of my rights under
the Fair Debt Collection Practices Act (FDCPA) and my state
laws so I hope to save both of us a great deal of time by
letting you know that not only do I dispute the validity of
this debt, I have also been advised that the Statute of
Limitations for enforcing this type of debt (time barred)
through the courts in the State of Delaware has expired.
Therefore, should you decide to pursue this matter in court
I intend to inform the court of my dispute of this debt and
that the "statute of limitations" has expired. I have been
also advised to counter sue for violation of the FDPCA and
abuse of process.
This letter is your formal notification that I consider this
matter closed and demand that you, or anyone affiliated with
your firm, stop contacting me regarding this or any other
matter except to advise me that your debt collection efforts
are being terminated or that you or the creditor are taking
specific actions allowed by the FDCPA or Delaware state
laws.
UNIFUND IS ATTACKING WASHINGTON
RESIDENTS - I received a summons from Unifund today stating
that I need to respond to them within the next 20 days; the
date of the summons is August 3rd;
They claim that I owe them over $2,000 against a credit card
I have never heard about. There has been no attempts to
settle this debt with me in the past, in fact I am not sure
what this debt is even for.
The local lawyers filing this petition are Suttell and
