Matthew Boddey and Karen Kelly Boddey, each and together doing business under the assumed names of National Acceptance, Continental Credit, and American Acceptance, are operating an ongoing financial scam, with their operations based in Colorado and Kentucky. Essentially, defendants purchase delinquent and time-barred consumer debt for a few pennies (or less) on the dollar.

Defendants then attempt to collect the unenforceable debt through abusive, deceptive and unfair practices, in violation of the FDCPA and MCPA. Among other things, defendants attempt to  coerce payment of unenforceable debt by threatening the consumer with litigation (even though any lawsuit would be barred by the applicable statute of limitations), by falsely stating to the consumer that a judgment has been entered against the consumer, by falsely threatening the consumer with immediate garnishment of wages and seizure of assets, and by falsely stating that derogatory account information will appear and remain on the consumer’s credit report until the debt is paid (even though it would be unlawful to report such information because of the passage of time).

Matthew Boddey is an individual, born June 27, 1967, and currently residing at 4603 Desert Varnish Drive, Colorado Springs, Colorado 80922-2385. Mr. Boddey purchased his Colorado residence on or about August 19, 2005 and moved there in or about  September of 2005. Immediately prior to residing in Colorado, Mr. Boddey resided at 1571 Chenoweth Circle, Bowling Green, Kentucky 42104-6357. Mr. Boddey also maintained a residence for a time at 10 Areque Ridge Drive, Colorado Springs, Colorado 80919-1802. Mr. Boddey is the husband of defendant Karen Kelly Boddey. According to the State of Texas, Mr. Boddey has two misdemeanor convictions.

Karen Kelly Boddey is an individual, born December 18, 1959, and currently residing at 4603 Desert Varnish Drive, Colorado Springs, Colorado 80922-2385. Mrs. Boddey moved to her Colorado residence in or about September of 2005. Immediately prior to residing in Colorado, Mrs. Boddey resided at 1571 Chenoweth Circle, Bowling Green, Kentucky 42104-6357. Mrs. Boddey also maintained a residence for a time at 10 Areque Ridge Drive, Colorado Springs, Colorado 80919-1802. Mrs. Boddey is the wife of defendant Matthew Boddey. Mrs. Boddey was convicted of check fraud in Duval County, Florida.

On August 25, 2000, Mr. Boddey filed a Business Registration Form with the City of Bowling Green, Kentucky, in order to operate a business named Continental Credit. The form named Mr. Boddey as the owner and sole proprietor. The form described the business as a collection agency. The form stated that the business was started on August 1, 2000. The form listed a business telephone number of (800) 877-2681.

On October 30, 2003, Mr. Boddey filed another Business Registration Form with the City of Bowling Green, Kentucky, in order to operate a business named National Acceptance. The form named Mr. Boddey as the owner and sole proprietor. The form described the business as a collection agency. The form stated that the business was started on August 1, 2000. The form listed a business telephone number of (800) 877-2681, which was the same telephone number previously registered by Mr. Boddey for Continental Credit.

National Acceptance uses letterhead with a business address of 1725 Ashley Circle, Suite 208, Bowling Green, Kentucky 42101. The business address is a small office suite. The office suite currently is under lease to Mr. Boddey. Although Mr. Boddey moved his residence in 2005 from Bowling Green, Kentucky to Colorado Springs, Colorado, Mr. Boddey remains current on his lease payments. The office suite is lightly staffed. Mail and other overnight packages, addressed to National Acceptance, are delivered to the office suite on a regular basis. The National Acceptance letterhead lists two toll free telephone numbers: 1-888326-2790 and 1-888-463-9053. Calls made to either number are answered by a female receptionist with the words “National Acceptance.

Mr. Boddey maintains another telephone line with the following number: (719) 622-0111. The carrier is Qwest Corporation in Denver, Colorado. Qwest records disclose that The number is listed to Mr. Boddey at his residential address of 4603 Desert Varnish Drive, Colorado Springs, Colorado 80922-2385. Calls made to this number are answered by a female Receptionist with the words “National Acceptance.” It is the same receptionist that answers calls Made to the toll free telephone numbers listed on the National Acceptance letterhead.
