H. Bruce Bronson and Richard J. Migliaccio (B&M)
are no strangers to the debt collection industry,
they started out in Buffalo, NY as Collect America
(CACV& CACH) franchisee’ many years ago. Over the
years, I have softened my rhetoric about them
because they did stand out (away) from the usual
sleazy, scummy debt collectors that come out of the
Buffalo, NY area. Bronson & Migliaccio instituted
training and guidelines for their collectors to
follow and for the most part, were not classified
with those that give the industry such a bad
reputation. I had many occasions to discuss their
debt collection methods and procedures with a
renowned and highly respected attorney who
specializes in that field, who assured me the
training they received was more than adequate.
As a number of
Collect American franchisee are now doing, B&M are
branching out on their own with a new bottom feeder,
debt buyer entity called; CSGA, LLC, a New York LLC
out of Purchase, NY. This entity is tied into their
attorney network with the idea of collecting on old
accounts, (many out of statute, with little or no
paperwork) in an attempt to make the pennies they
paid for them, turn into a big bucks payday.
Paperwork sent
to me, filed on a Texas resident by Bronson &
Migliaccio’s Associate Attorney, Mary Elizabeth
McLauglin, of San Antonio, Texas, had me wondering
if she has learned anything in her thirty
years of practicing law. Her pleadings are false,
absurd and so full of contradictions they are almost
comical. The documents she included in her Texas
filing are so bad, they should be used by debt
collection attorneys on how NOT to file a
credit card claim. I was so shocked at the
unbelievable statements made by this attorney that I
would have bet she was fresh out of law school.
Imagine my utter disbelief when I read she was
licensed… in 1976. (She even had the audacity to
ask the court for $1300 in attorney fees! What was
she thinking? Do you REALLY expect to get paid for
lying?)
The affidavit
she enclosed was from the State of Kansas, by a
‘Michael Schuler, Vice President of American Debt
Sales, LLC.'
Of course
Michael lied when he stated ‘he has knowledge of
said account sold to CSGA, LLC and the balance of
said Account indicated thereon are accurate to the
best of Affiant’s knowledge and belief, based on the
balance represented to the Seller…”
The kicker on
this is the account was originally sold to bottom
feeder; ‘American Debt Sales’ by another
bottom feeder, ‘Atlantic Credit & Finance,
Inc.’ So a bottom feeder sold an account to a
debt buyer, who sold it to a bottom feeder, who has
an attorney that states she has knowledge that the
debtor breached an agreement. Mary Elizabeth goes on
to state many other facts which of course she knew
to be false as they are all hearsay. Would an
attorney intentionally lie on a court pleading? Can
Mary Elizabeth McLaughlin be held accountable for
this (and how many other) cases she filed containing
the same B.S?
LIARS, LAWYERS, CON MEN AND THIEVES…
It’s
all about money!
Attorney Mary
Elizabeth even included a copy of ‘a’ credit
agreement, to give her paperwork the appearance of
authenticity. However NOTHING in her filings has
even a clue, not a hint, or an odor of legitimacy
that the person she sued is in anyway liable for
that debt. Should lawyers like Mary Elizabeth
McLaughlin be allowed to do this? NOT IN MY BOOK!
Attorney
McLaughlin is not stupid, she is trying to make
money based on unsophisticated consumers caving in
with a check, or taking a default judgment at the
courthouse, so she and her fellow debt collectors
can reap a fat paycheck at their expense.
If Texas
Attorney Mary Elizabeth McLaughlin is an indication
of how Bronson & Migliaccio are now doing business
then anyone finding this site may have an
opportunity to level the field. If you are
contacted by CSGA, LLC, contact me for assistance
and referral to a REAL attorney who can assist you
in dealing with them. This is fraud; deception, lies
and just plain garbage, Attorney McLaughlin and her
CSGA, LLC associates should be held accountable for
their actions.
Attorneys defending
consumers on CSGA, LLC suits who would like to see
copies of these affidavits and other information are
asked to contact me.
CAUTION:
I recommend you
NEVER
disclose your bank account or credit card information to a debt collector, as you
risk them emptying your account, or maxing out your
credit card. If you feel they are reporting on your
credit bureau files in error or need assistance in
dealing with them, email the details
w/your
location. Assistance and referral to a consumer
legal specialist may be available.
