Debt buyers who use a national network of attorneys to attempt collections on bottom feeder portfolios.  With the steep decline in available portfolios since 2006, this organization may find itself out of gas or severely hampered by large overhead and big plans that may not get off the ground.

 

Their bigger problem and what may ultimately be their downfall is the quality of the paper they collect on and their inability to legally provide documents meeting court criteria. What used to be easy lawsuits a year ago are now being dismissed in record numbers because of the poor quality and tainted allegations that follow these warehouse type operations.

 

Many of attorneys in the (so called) network already have reputations for not showing up in court, hoping for a default judgment or are the first to request a postponement of a case when an attorney or pro se defendant is there to challenge them. Why? Same story, new verse, they just don’t have anything to show and many are not even vaguely familiar with the content of their filings. Attorneys who work in these type networks are historically the one’s who didn’t finish at the top of their class, have already changed legal careers in the past and the number who are lacking in FDCPA procedures is a joke.

 

Bottom line: ALWAYS show up if sued, hire a competent consumer attorney, make them prove everything, watch their cases fall apart.
