Whenever you get a BIG law firm in the debt collection business, you have
problems that are inherently unique to that firm’s size; everyone wants to
get paid. In order to do that, you stoop to lows you may not consider under
normal conditions. Javitch, Block & Rathbone (JBR) files a LOT of debt
related lawsuits in Ohio and other areas on behalf of bottom feeders.
That a lot of the cases filed on behalf of these debt buyers may be time
barred by statutes, or the basis of the suits contain bogus affidavits and
perjury laced pleadings apparently do not affect the suits JBR files.
JBR list 45 attorneys on their website involved with their operations. That
means they have several hundred working there as support staff to help feed
these lawyers and that equates to a HUGE payroll.
These bottom feeder suits produce income from:
-Folks on Social security disability income.
-Debts that are ‘Time Barred by Statute.’
-Debts that are too old to be reported in credit files.
-Consumers who may have discharged those debts in bankruptcy.
-Co-signors on accounts who know nothing about the debts.
How many debt collector JBR
lawyers realized when they were in law school that their
paychecks would result in so much misery to others? This
is not just about collecting on legitimate debts.
It’s about the RULE OF LAW! Debts and judgments obtained
by false pretenses, bogus claims, perjured filings and
phony affidavits make the lawyers involved as dirty and
disgusting as the people who hire them. The appearance
of law and ethics does NOT cleanse the slime from your
hands and your paychecks.
Consumers are urged to challenge the validity of anything being represented
by Javitch, Block & Rathbone. Send them dispute validation notices, invoke
the Fair Debt Collection Practices Act (FDCPA), and make them prove up each
and every item. Challenge any affidavits and pleadings, make the signors
testify to the truthfulness of their statements. We have seen over and over
that bottom feeder lies can be defeated. The vast majority of cases we have
seen, filed on behalf of bottom-feeders contain hearsay statements, that may
NOT be admissible in court. Make JBR and the people they represent prove
their lies. Tape their calls, (where legal) most
collectors will lie, make threats, break the law, tapes go a long way in
settling cases, based on my experience.
