March 2010 This agency has been told twice over the phone that the person they seek at our home number 1) doesn't live here and never has 2) hasn't had THAT last name since the mid-90's and 3)please take our number off your database. I happen to work not only in the same building, but on the same floor as their executive offices. Do I dare go to the exec office to ask for the removal from them?
September 2009 I can't believe it. These bottom feeders sent me a letter for an alleged debt from First Premier bankcard from 2000. They got this from Arrow Financial. Is this even collectable - it's way too old! What the hell is it going to take to clean the credit/collections industry up? This is nothing short of extortion. How in the hell to these A-holes get away with it? Because it's out of control and no one wants to do anything about it! 7 years on credit reports is crummy, it should be 3 MAX - At my rate, this will go on for the next 100 years as one CA will sell it to the next - this is NOT right and needs to be corrected!
September 2009 Just received the collection letter in the mail from Capital trying to collect on an old Sears account charged off way back in 1997. They say I owe over $18k. The balance was never anywhere near that. Since those days we have cleaned up our credit to the point of purchasing two residences, and enjoying o% financing plans on our vehicles etc. . I'm wondering if they stuck this back on my credit report as I have been receiving notices of rate increases and my credit card companies lowering my credit limits. If so, what should I do, especially since this activity will snowball and all together create an ever worsening credit score.
September 2009 I have been receiving calls from Capital Management for months. Each time, I have politely told them they have the wrong number, as no one by that name lives here. I suppose they don't believe me, as they keep calling and calling and CALLING! Yesterday they struck my last nerve! It probably didn't help that we're having a record heat wave... I answered the phone and went into my "you have the wrong number, no one by that name lives here, please stop calling us" routine, only to have the guy at the other end of the phone, talk OVER what I was saying. How rude! I found myself getting LOUDER and LOUDER to talk over him! I asked him to STOP HARASSING ME, YOU HAVE THE WRONG NUMBER! And..."Let me speak to your manager." He refused, so...I picked up a whistle I had on the counter and blew it as loudly as I could into the phone. I have to tell you, after months of these irritating calls from Capital Management, that felt pretty darn good! Then I hung up. The phone rang almost immediately, this time the caller i.d. gave a Buffalo NY # and didn't say "Capital Management" on it. But it was the same guy. He said, "I can't believe you did that!" I replied, "I can't believe you keep calling!" I asked again to speak to his manager and he refused, and started blathering at me again. I hung up. The phone rang again...."anonymous" calling. It was him, of course. This harassment continued for a good half an hour. In between the calls (which I wasn't answering, of course...not that it stopped them), I called Capital Management directly and asked to be put on their No Call List. I was told I would be...but as soon as I hung up from that call, Anonymous called again--and again--and again. ARRGHHH!!! I've filed a complaint with my state's attorney general. Not that I think it will do much good...
September 2009 These people call me at home, cell, work and my HR folks at work at all hours…early, late, 7 days a week. I never talk to them…I did leave a message a few weeks back to stop harassing me at work and the calls stopped for a while. This is about a debt that has not been paid on since 2001. I’m in S C. Is there anything I can do?
May 2009 After
harassing phone calls at work from Capital Management I quit
answering the phone when there number came up. They finally
got tired of that so they threatened to send a fax to the
Human Resource department on my voice mail. They did this
last week. Human resources had the paper from them to verify
my employment and who my boss was and how much I made. The
name of the company was on the header. Is this illegal? Are
they in violation? I told my company not to fax this back to
them. They said they will not. This will tick them off. This
has
not even gone to court and they are pulling this. Can I sue
these jerks for this?
Capital Management pays out a lot
of money in lawsuits. It is illegal for them to make your
debt known to a third party. That fax may give you a free
ticket to suing them. I am sending you to an excellent NACA
attorney who can assist you and perhaps put some money in
your pocket. The collectors working there are not too
bright, many may have drug and alcohol problems. Call the
attorney, make them pay.
April 2009 Hired by Original Collector to collect on a account I am behind on. They called asked for me and then a lady proceeded to be nice and tell me they had a financial hardship program they wanted to work out with me. She asked me if I refused to pay the account, I said no, then said she needed to calculate how much my monthly payment would be. Well she didn't return to the phone! A man did and he said he was a supervisor and started yelling at me saying I needed to borrow the money and I could settle the account for a lower amount. They are sneaky crooks! I should have known after seeing them on Dateline in their scam operation.
March 2009 Received
a call from 877-211-9178, co called CM Services. Some little
bitch wanting to know property address for filing a lien on
a credit card that was last paid on in 2001. Tried to tell
her she was too late, just went off trying to impress me in
her Buffalo accent of my potential problems.
We edited your letter, liked the
accent. They are Capital Management Services, Buffalo, NY.
They have a bad reputation for threats, posing as someone
they are not and using various scams to get money. Your
state statute was four years, she is a little late. I am
aware that their legal counsel is still paying off on claims
so anyone dealing with their latest con should tape their
calls, (where legal.) A good tape could (potentially) make
it very easy for your consumer attorney (contact me for a
referral) to negotiate a settlement, if warranted. As these
collectors grow more desperate, so does the originality of
their scam. Don\'t be fooled, a con is a con, all they want
is to take your money. Stay away from CM Services and their
lies, they are nothing more than chicken wings flopping in
hot sauce, looking for a free ride!
January 2009 I was called today by my great aunt patty who is 95 yrs old and in a assisted living home. This company called her looking for me regarding a legal matter. I live in FL and she lives in NY. Sadly I have only met my great aunt about 4 times in my life, I am 29. I would never list her as a reference. Anyways, I called them and they blind transferred me to a supervisor Mr Young. He was rude, would not give me the name or account # of the credit card he was saying I owed. I asked that he send me verification. He refused. He kept demanding my credit card information to make payment. I of course refused. After being yelled at and belittled by him I hung up. I do not know what to do. I have credit problems and have been trying to correct them. I have been taken advantage before and given my card to a creditor that I thought I owed and was taken for all the money in my checking account. I had to change banks to get them to stop taking my money. I am going to look over my credit report I may owe this debt but I am scared to give them my credit info. Also the debt they say I owe is from a credit card opened in dec 2004 and last payment was dec 2007 and it has been delinquent for 36 months.

NO! Your state statute has already run out, so has their
right to report it in your credit files. We are receiving a
number of complaints on Cap Management collectors, all are
old, stale, out of statute debts. Be VERY careful about
sending them money as some states allow that just one
payment restarts the debt collection clock. Don't fall for
the lies or the threats of a desperate debt collector. It's
winter and they are in Buffalo, NY, do you think they could
be a bit desperate? This agency appears to be hurting
because they can't obtain 'fresh' paper, so expect the
calls, threats and lies to increase dramatically. You do NOT
legally owe a debt that is past your state statutes. If you
need assistance, get in contact with us, save your money!
January 2009 I received a letter from them about an account with Elite Recovery Services. I called CMS three times in one evening to try and figure out what the heck is going on. Not once did they read me the mini miranda. Sounds like the Elite failure caused the portfolio to be sold to Capital.
July 2008 I work in the same building as these yahoos...Thank God they got their own elevator so the rest of us decent folk don't have to risk our lives riding the elevator with them! I found out from folks who know (don't want to get anyone in trouble) that Capital Management has reduced the overtime hours and has stopped work on Sundays for the summer. Maybe they aren't collecting enough lately...
July 2008 This company calls me daily looking for my brother. During the first call I asked what this was about, they told me that he owes HSBC money on a credit card. I was amazed that they would disclose this. I refused to talk to them any further, but they keep calling and demanding information... I had a shouting match with a woman (I'm being generous here) named Anne... It's amazing how many time they have been sued...
July 2008 I have received a message from them today, as well as one being left at my parent's. I tried calling and was on hold forever. I finally hung up. As to this company, has anyone even looked at their website? Under the FAQs link, it's a joke. Take a gander and have a good laugh. It's obvious this is not a professional company. At this time, I am not sure what they are calling about and have no intention of giving them a chance of informing me over the phone. What happens if I never respond?
June 2008 CMS is quite frankly the wild wild west of Buffalo collection agencies. Their hiring practices are worse than any employer I've ever seen. I know of a manager who recruited 2 guys from a holding center after a night stay in jail for disorderly conduct. He came to work bragging about his newest "young bloods." I have worked there for about a year now, helping put myself through school. The things that go on there are unbelievable. It is more micro-managed than the Initech on Office Space, and all of upper-management is paid to yell and scream at people as if they were children. There is one Vice President in particular named "TJ", which is probably not his real name. Judging by the way he humiliates people all day long, he probably has to conceal his real identity. I am convinced this man has a raging crack addiction and have heard many rumors of this to be true. He literally runs around all day long insulting people who aren't on the phone or at their goal. Another manager once walked around selling painkillers out loud as if he had candy. The floor is full of people and he's offering drugs to anyone who wants them. Of course they were gone in minutes. The company does business with Chase Bank which is a prime client of theirs. And one of the more respectable ones in the industry. They have mandatory drug testing for all collectors who wish to collect on their behalf. It is the job of the various vice presidents and managers to stay on top of drug testing for this client. I know people who have worked for Chase since I've been there that still haven't taken a drug test. Because they would fail miserably. The managers will say "oh don't worry about it, we will give you more time, just keep hitting your number." You will overhear conversations amongst collectors on the floor about their loose sex lives, what drugs they did on the weekend, who they're sleeping with in the office, etc. It's just pathetic. Once such manager Nick M. openly brags about sleeping with the hottest girl in the office and he's a married...
May 2008 CMS first contacted us a couple of months ago, asking for my wife with a mechanical answering system. They left no name, just a number, calling it urgent. This went on, day after day, for two months. It was only at the start of April when the machine identified itself as Credit Management Services. We tried calling them several times, calling the toll-free number, but were left on hold for a long time each time. It was only when we finally did get through that we heard it was a small amount, but the person we talked to insisted that we give the information for payment. I promptly told her that we would deal with the original creditor, and hung up. A week later, we got another call, same person, insisting that we agreed to pay with a credit card, and basically demanding information about it. This person claimed they mailed something to us three times, and that was all the law was allowed, something I found out was not true, and that they could not mail us anything more. Since we received no mail from them, I told her (basically giving her a chance) to either mail us something or to stop bothering us. These people are relentless in their harassment, and they will not necessarily mail anything. If you get through, get them to agree to mail something, and, if they do, report them directly to the FTC. They are well on their way to knocking NCO off the top.

regarding an alleged account with Resurgent Capitol
Services, LP. (servicer of the account) stating they've been
engaged by them to collect this alleged account. I've never
heard of any of them. They show LVNV Funding as a current
creditor. I sent them Certified request for Validation and
never heard from them again. They must be connected to LVNV
Funding somehow. Their number is 800-395-0571

March 2008 I worked at capital Management services for about 6months, this was one of the worst jobs i ever held in my life. for god sake i wasn't even able to go Pee in peace with out being yelled at about getting out of my seat! working an 8-9hr shift with a 45 min lunch and 15 min break..., where they don't even allow you enough time to consume your food. this job is a gimmick, i was told plenty of times that i had made my goal.. but never received a bonus check, because my payments got stolen by other collectors!! id say more but its to much to type this job sucks!! and if they call u don't pay them!!
2007 CMS insists on diving into your credit record then sending demand for payment letters (without verification statement or cease communications clause) well after debt is past statutory period. At least they now admit that they are debt collectors and not something else.
2007 My credit check monitor just
informed me that Capital Management Services made two new
inquiries on my report on 10/17. Know they are bottom
feeders and debt is all past Statute. Thanks for info on
them Bud - just a warning to all that obviously they bought
some more old debt and are doing inquiries. Expect harassing
correspondence any day now. You would think that once debt
is past statute they would not bother trying to harass for
collection and should be barred from doing credit inquiries
once statute
has passed.
2007 The Better Business Bureau of
Upstate New York expelled two contractors from its
membership because of unanswered and excessive complaints,
and two Williamsville collection agencies resigned before
they could be expelled, the organization said Wednesday.
The board of the Buffalo-based business standards group
voted to kick out Gary E. Reid Construction of Youngstown
and Pine Ridge Log Home Restoration of Lacona, northeast of
Oswego. Both decisions were due to unresolved complaints.
The board had already suspended the memberships of
collections firms Capital Management Services and National
Action Financial Services because of an unusually large
number of complaints that exceeded even other collectors.
But both firms resigned from the bureau prior to a vote on
expulsion.
2007 I worked at CMS for a
year and some change. The owners of CMS overwork everyone on
their payroll. Especially the upper management. The average
workday for one is like 7:30am to 9pm. If you're a
collector, and you don't have any payments up on the board,
they'll try to humiliate you.
The turnover rate is horrid. If you don't hit a decent
number within 90 days, PEACE! They'll hire ANYBODY. ANYBODY!
If you can hear, speak, and use a computer, you're golden.
When I came in for my interview, I saw people wearing t
shirts and jeans to an INTERVIEW.
CMS is a collections sweatshop, if you will. You sit in a
small space, and try to find a phone that works. If you're
out of your seat trying to find one, they yell at you.
They want $30 monthly for PARKING at the Exchange St
location $20 per pay period to dress casually. It goes to
'charity' they say. And $25 for a hands-free headset. If you
go on break and leave it at your desk, it WILL be stolen.
As far as drug use is concerned, you almost need to be on
something to withstand a day's stress at that place.
2007 I am ashamed to say that I worked for this company. We were bought out by CMS last year and it has been a joke ever since. We had a turnover of greater than 150%. I had to visit the Buffalo office and was appalled at the way they treat their employees and debtors. I have always made decent money in collections but have never stooped as low as these " thugs " do. I have always treated my customers " debtors" with respect but that is not what CMS wants. Their directors and "owners" are a bunch of egomaniacs. I lost several large settlements due to their authorization dept being nasty when they were verifying the check or credit card info. BEWARE
2007 Jollene called me yesterday and left a message to call her back at 866 843-9116. I called back, was told she left and I was speaking with her supervisor (which I didn't believe). I owe Sears over $6,000 with no validity. This so called supervisor asked what I was going to do. I told him I could pay $100.00 a month as my husband lost his job. We are slowly getting back on our feet and $100.00 is the best I can do as I am working with other agencies and am already on payment plans along with trying to pay our monthly bills. He did not believe I would pay a $100. as I haven't paid Sears in a year. He said why don't you just hang up and tell us you won't pay since the phone call is recorded. I told him that is exactly what he wanted and he was urging me to do so. I told him to stop bullying me and that he wanted me to hang up so he would win. I was willing to pay but he wanted more. He was rude, a bully and had no understanding of our financial situation.
2007 These are the RUDEST people on earth! They are harassing us on a debt they say my husband took out over 20+ years ago. My husband does not remember any loan with the company they claim it was originally taken out with. We have asked for proof & they refuse to send anything. They say it doesn't exist anymore. If no proof exists why would I pay it? I told them they couldn't collect after 20 some odd years anyways. If he hadn't paid in 20 years, he wasn't gonna pay now & they could kiss any commission they expected to make off us good-bye. They call anywhere from 3-12 times a day. They start at exactly 8:00 am and up to 8:59 pm. They hang up on you, belittle you, guilt you, etc. I hate to admit it, but I have become just as nasty as they have. I waited til we were dead heat in the middle of conversation & blew an air horn into the phone. I have reported them to the Federal Trade Commission & if they continue with their illegal practices, I will obtain legal council & they will be in debt to me!!
2007 They recently contacted me regarding a debt from over 3 years ago. They have threatened to sue me for twice the amount that I actually owe. They are very rude. It was obvious that the caller was overworked and possibly stressed out of his mind. He called back twice and hung up each time I guess expecting me to call back. I never did. They will make horrendous threats banking on the fact that consumers don't know their rights. Just hang up. There needs to be some serious investigation into theses practices. I know the FTC has a lot of cases going but just not enough.
2007 This company is nothing short of a
bunch of thieves trying to hassle and force you into random

disputed debt (that is not even mine) is 13 years old and a
below average intelligence agent called "Paul Standish "
call you and tell you that the burden on a bogus debt that
he made up in his mind while doing cocaine is upon you, Just
laugh at him and mention the magic words: "Statute of
limitation"
They know better, THEY will NOT file anything, just try to
scare you to admit a debt and hassle to you pay it to stop
the calls. In CA, after 4 years, you cannot collect a debt
EVEN if it belongs to you, so much for a 13 years old
phantom account. Call them, make fun of them without giving
any information. I told horseradish, I mean Standish
that he owes me $1 BILLION. How would he like to settle it??
And he was speechless. .Ask them for a $1 billion that is
their burden of proof to show is invalid. Good luck and DO

2007 This agency is the worst. They call several times a day. They have been state they want to talk about something submitted to them from Will County. I live in Dupage. They make it sound like a lawsuit. But, I have never had anything going in Will, never lived there, never anything. They do not seem to know that most of Naperville is in Dupage not will. I don't care if they send it to will. I did not know who these people were so I looked them up on the internet and found that they are just a collection agency. Well then no one from Will county would be sending them anything. They would be getting something from a credit card or something, but no one is in Will and I have never had any problems with any one from the county either.
2007 I have never had a problem with this company until recently. One of their reps called me and offered me a settlement on my account. He told me if I could make a payment that day of $701 he would break the remaining balance into 9 payments of $309 due the 20th of each month. On the first of each month a lady would call my home and cell to request payment. I would have to explain each time I can not make payment till 20th and first rep had told me that would be fine. I just made my last payment to them this month and called to check my balance. The lady I spoke with said I had to pay 12 payments of $309 not 9. When I started to ask about the arrangement I has setup she started yelling at me. She told me I should be grateful they settled in the first place and if I had paid my account like I was supposed to it would not have come to collections. She was rude and very disrespectful. I have worked for a collection agency for 2 years and if I ever spoke to someone like that I would be wrote up! She hung up on me so I called back and asked for a supervisor. He just told me I didn't understand their job and it was ok for her to talk to me that way. He in now way offered to try to resolve the situation, told me didn't care what payment I had originally set up. I still has an account balance and nothing he was going to do. This company is awful and should not be allowed to continue to lie to their consumers.
2007 Collector I would like to say a few words about capital management as i am a former employee. capital management services also known as cmsi or cms, is a borderline sweat shop. there are 1000 people crammed onto 1 floor. There is 1 elevator that is the only way to the 7th floor. (the floor capital management is located on at the exchange st office) collectors shuffle in every day at either 8am or 330 pm (to 33pm or 11pm) to meet their over over exhausted managers that have been there for 15 hours straight. the managers and collectors then get screamed at by a coked-up tj (office manager or vp or w/e) collectors are using dirty old un-sanitized phones and equipment and are crammed into rows. there is cocaine all over the bathroom floors and stalls in both the men's and women's bathrooms. this is an everyday thing. capital management is disgusting and so is anyone that works there. it is an office filled with drugs lies and so much other illegal activity. do not support tj's cocaine habit, do not send them a dime. and def. do not give them your bank information.
2007 Collector I worked for Capital Management Services for 2 years as a debt collector and made very good money. I was collecting $2,000 bonus checks monthly and was making a solid $14 an hour on top of that. But the things that go on there forced me to quit and seek another agency.. Where i am doing decent but not as good as it was there. The 1st time the company collected 10 million dollars in a month and every month after that.. The owners had huge parties with the managers in the back offices of the exchange st building. This involved very heavy drinking which caused some managers to go home early...but some others stayed and did talk offs while being very very drunk. Also...their managers are overworked and paid very well to compensate their missed time from their family. They all work between 60-70 hours a week at a minimum and are not allowed lunch breaks. They are screamed at by tj senft and the other vice presidents. This company is disgusting and do many illegal things to get money....thanks
