November 2009   There is nothing on my credit report indicating I owe anything to this company but they are calling me about a medical bill from 2005. I continue to ignore their calls and they continue to dig up my information and harass me. Every time I have run my own credit report all of these strange creditors come out of the walls.


October 2009   I decided to cancel my AT&T account because I had wireless internet and never used the home phone anyways. When I did this, I requested a final bill be sent so I wouldn't have any surprises. Instead I received 2 bills with different amounts. I called them back and again stated I needed a FINAL bill. They said they would send one. It took several weeks and in the meantime I starting getting these calls from Bay Area Credit. I informed BACS that I would be dealing directly with AT&T not them. They acted like they didn't understand and kept asking me over and over for my CC# or bank account info. I finally got the bill from AT&T and paid them. I still kept getting calls from BACS. I explained that I paid AT&T, they told me it was my job to prove to them I paid it. I said no it's your job to validate debts not mine! The Indian woman became very rude and I got rude back. She then transferred me to another person, I attempted to explain that I paid it. He kept cutting me off and telling me I should pay it anyways. He then got very obnoxious and started telling me I'm lazy and probably don't even have a job. I explained to him I did have a job and that wasn't the issue. He then started asking me where I worked and how much I make. I again said that's none of your business. He then started asking me if I own my house, how many vehicles I own, do I have a 401k... I said, ok this is getting way personal and this is NONE of your business. He said that I should be ashamed of myself for not paying him. I really went off on him and he hung up on me. I didn't get another call and after a few weeks felt that maybe they finally got the correct information. Now it's been 9-10 months later and I got a call from them again today! I told them I paid AT&T and they had no right to call me. She said that she does have a right because my account is still "due" and active with them. I said yes but AT&T is who I owed the money to and I paid that, she said no you owe us not AT&T. I informed her that I wanted them to validate the debt with the original creditor and I wanted it mailed to me. She danced around that and went back to saying, why don't you just pay this, give me your CC#. I said no, I have rights and I want you to do your job! She said she knows more about the law than I do and she is within the law and will continue to call me every day.


September 2009   These people keep calling my business asking to speak to somebody I've never heard of. When I asked to have my number removed they don't even know which of my three phone numbers they called. I gave them all three but so far no luck getting rid of them. I can't put a business number on the do not call list but it's getting crazy the number of calls from these yahoos. It's really just harassment at this point.

February 2009   Any one reading this needs to record audio to reveal more details of their tactics. I am doing this now as they call on a daily basis. I find it appalling they cant communicate well with Americans. Ghandi would be ashamed of their low life attitude. I agreed to pay my so called debt by check in the mail and they turned around and called the next morning demanding the same. I told them I would not pay them one dime until the calls STOPPED! Now someone has put up a website discrediting this website and they hacked it off the web


February 2009   Received a phone call at 8:05 Saturday morning and the caller hung up the phone. Phone number was 800-570-7961. I called the number back and discovered the agency number. I am not delinquent on any bills. Asked to have my number removed from their database and was told that would not happen. I researched their information on the net and have been calling their numbers since that time. I ask everyone to call these numbers as much as possible to jam their phone lines. Numbers are all 800 and 570-7961, 697-1234, 862-4187, and 454-2227. Thanks


November 2008  Bay Area has moved their major call center to Atlanta, GA 1000 Abernathy Rd. (formerly Superior Asset Management) Building 400, Suite 165  Atlanta, GA 30328  They are working old accounts that are not producing as expected. The owners are not happy with money flowing out as far too many debtors are refusing to pay. Expect to see a lot more threats by collectors, they are feeling the pressure from above. Managers are being told to hit their quotas or hit the streets. I'm told this is happening to a lot of Atlanta agencies because of the economy.

Bay Area has been a constant source of consumer complaints. The good news is they still have deep pockets and are able to pay off on lawsuits. Consumers should make them validate all claims and record their calls where legal. We have heard from other places that Atlanta is not doing well in the collections area.


October 2008   I feel like I am being stalked by these people. They called asking to speak with Clarence. My secretary told them there was no "Clarence" here and never had been. Two minutes later they called again and I assured them that Clarence does not work here. Several calls later they are now asking for me by name saying they have importance business to discuss about my _______ Clarence. I cannot understand half of what they say. The number they are using to call me is 1-800-841-2316. The worst part is that I am a collections attorney myself. These guys in India have a pretty worried. Especially now that they seem to be linking me to some guy I have never even heard of. They know my name and my phone number and therefore, my address. How can I prevent them from suing me?


September 2008     These people called 10 times starting at 8AM. Each time I answered all I got was a recording to call (866) 773-9877 with a reference number. I also received a letter from them in the mail stating they were collecting for an amount that I allegedly owe Arrow Financial Services. Are these people collecting for another collection agency? I have never heard of Arrow Financial Services and they claim I owe them money. I don't think so. I am sending a debt validation letter to them and a cease communication letter. This is ridiculous. Also when I checked my credit report Arrow had placed a negative entry on it stating that an account was opened in March of 08 and I had missed 3 payments and was 120 days late. I am also disputing the entry and requesting validation. Why do they get away with these tactics? Are these two agencies working together?


September 2008     They are now calling and leaving a message on the answering machine that they need to contact someone other than you. Please give them a call reference #...... When you call and let them know that there is no one by the name of that person they call you by your name. They are using a fake name they are attempting to get in touch with, once you cal they have your phone number and said they are not looking for the other person but looking for you.


August 2008     Very Rude threatening will not give info. Told them send me a letter with all info according to Federal Law told me don't quote law to him. Said he will call every day etc.etc.


June 2008    I have been under attack by these debt collectors from India on an old ambulance bill from 2001. Their accents are terrible can't understand anything they say. I tried to tell them the debt was paid by insurance they have no idea what that means. Why do they use these India callers? They are really dumb, you can't understand them, they have no clue what they are doing. Have they not learned that Americans will not deal with India call centers? I read where they are paid $3.00 an hour, I think they are over-paid. Hey India, I'm not sending you any money.


June 2008    Bay Area Credit has really began scrappin' the bottom of the barrel when it come to hiring live bodies to answer the phone when their automated dialing system calls your home phone and you wait for them to pick up. I happened to be home this afternoon when they called and I waited for their same rote speil about an ambulance bill from 2002 covered by Workers Comp Insurance. I goded and harassed the guy so badly, that he called me back on his personal cell phone to avoid being recorded on Bay Area Credit's recorders to try to harrass me somemore. He did not even have the intelligence to even do *67 to block his number from my Caller ID, The number is 678-486-1027. Google whocalled.us and lookup that number. Surprise! You will find it belongs to some goon at Nationwide Credit (another fine collections agency!) I have sent Bay Area Credit a validation letter over 30 days ago and a CEASE and DESIST letter over a week ago, yet I'm still getting calls on my home phone number. And all of this #%&*?! for a grand sum of $54.10 that I DO NOT OWE! Anybody else fed up with this Call Center Crap from India?


June 2008    I am the caregiver and legal guardian for my brother. I have been taking care of him and his finances since 10/2006. I got a call one day on my cell phone from someone who could not speak very good English asking for my brother by name. It was the Bay Area Credit Services. I explained to him I was the legal guardian for my brother and what was the call in reference to. He told me a debt for $136 and another one for $78 for ARS. He could not tell me what ARS was but that I needed to pay. Told him to put it in writing. He did and the debt collection letter mentioned ARS only. A few days later I got another call, same thing as the first. Told them not to call my cell phone and to put everything in writing. I sent an email to Bay Area CS wanting to know who ARS was. They referred me to an 800 # which led back to the folks who cannot speak English. I sent a CMRRR to BACS for validation of the debt. No response. About 2 weeks later I get another call demanding payment. Told the non English speaking jerk I was not paying something that I had no clue what was and even if my brother owed the money. I told him to get me someone who spoke English. He insisted on speaking to my brother. I told him he was in a nursing home and I was his legal guardian. He said I need to know where he is so I can speak to him. I said LOOK, he does not handle his finances any longer, I DO, and I will not pay something I have no idea what is. I ask for his supervisor and got one. The guy did speak better English and was actually nice. He told me who ARS was and the debt was from 2002 and I needed to pay it. Ok I explained to him that I was an informed consumer. I had my brothers best interest to look out for and that BACS was in violation of the law for trying to collect a debt that was out of SOL. He informed me that his company followed the law. I told him that obviously they were not aware of the laws in the State of Mississippi and that the SOL was 3 years! I informed him I did not intend to pay this debt because # 1 they had failed to val

Thanks to Bud Hibbs, this site and other sites regarding junk debt buyers, I knew my brother was no longer responsible for this debt. This company is a scum bag junk debt buyer who does indeed farm out their accounts to India.


May 2008    Apparently I have a new number to add to your list of numbers for Bay Area Credit Services. Tonight we received a msg from them for us to call back and stated that they were not a solicitor nor selling anything.

May 2008    Seems they're getting creative....

I recently got a letter from this agency about a credit card debt for which the SOL expired about 5 years ago. They want me to transfer a "settled balance" to a new credit card, interest-free, which will wipe out and reset the clock on the SOL.

I sent them a cease-comm letter advising them that the SOL has long expired, using a form that I created based on a letter submitted by another visitor:

To Whom It May Concern:

This letter is in response to your letter dated xx/xx/xxxx, received on xx/xx/xxxx, regarding an alleged debt in the amount of $xxxx.xx, account/reference number x.

This letter is your formal notice to you that any filing of any civil action or other collection activity regarding this alleged debt by you or any of your assigns or representatives, is now time-barred.

As I’m sure your legal department is aware, each of the 50 states has a Statute of Limitations for a junk debt buyer or collection agency such as yourselves to report, collect debts, and/or bring suit against debtors for alleged debts. In my home state, the statutes are as follows:

Open-end accounts: X years from the date of first delinquency
Written contracts: X years from the date of first delinquency
Promissory Notes: X years from the date of first delinquency
Sales agreements: X years from the date of first delinquency

As you can plainly see from the date on the “billing statement” that you may have provided to others but never sent me a copy of, you are far beyond the Statute of Limitations for collection, bringing suit, or obtaining a judgment. Since this alleged debt is clearly beyond the legal time frame for continued collection activity, you are to immediately cease and desist all further contact with me.

As a result, I must insist that you take the following actions:
- Notify your client this alleged debt is now time-barred and can no longer be pursued by any means whatsoever
- Destroy any and all records of this alleged debt in your possession, and instruct your client to do the same
- Send me a signed letter that releases me from any further obligations regarding this alleged debt
- Do not contact me further about this alleged debt by any means whatsoever
- Do not sell, assign, transfer, or share any information about me or this alleged debt with anyone else
- Do not report any false information about me or this alleged debt to any credit reporting agencies
- Do not send me an IRS Form 1099-C

Thank you kindly for your “attempt to collect a debt.” I trust that after receiving your signed release letter, I will not be hearing from you any further.

If you do not comply with the above requests, I will have no choice but to file a formal complaint against your company with the Federal Trade Commission who is responsible for enforcement, the United States Attorney General’s Office, the American Collectors Association, or your local State Bar Association, or bring a civil suit against your company in the my, county and State.


You are also notified that should any adverse information be placed against my credit reports as a result of this notice that appropriate actions, including but not limited to those listed above, will be taken.

Being the reasonable people you claim to be, I will assume you will realize that a time-barred debt  your company or client probably paid less than $9.00 for is not worth the time and expense of a court case, and that you will comply with my requests.

This is an attempt to make a debt collector comply with Federal Laws. Any information obtained will be used for that purpose. Any printed copy, photocopy, or telefacsimile of this document shall have the same force and effect as the original.


Bay Area Credit has a sneaky way to avoid validation requests: they simply do not pick up any certified mail notices from the PO Box addresses listed on their initial communication letter! They pick up all of their payment envelope mail but just leave their certified mail notices to gather dust! How sneaky can they get! As soon as my certified letter gets "returned to sender" because they refused to pick it up and sign for it, I will hand deliver it to my attorney's office along with the "track and confirm" posting from the USPS website showing their deliberate attempts to avoid my certified mail letter requesting validation. Their intentional & deliberate actions of not responding to USPS certified mail notices is a FDCPA violation: "A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt."

2007    I received a call last night from a collection agency that must be using offshore call centers. 800.697.1234. showed up on my caller ID with the text "toll free service". The lady to whom I spoke with had a very poor command of English. She asked for my wife to which I replied "she's at bingo". She then stated "what is this bingo" and then asked who I was. I then began to let her know that it was not any of her business of "who I was". She hung up before I could finish. I then went to the website "who called us" to check who the number left on my caller ID belonged too. It was reported as belonging to Bay Area Credit. I have never had any business with these people.
I find it hard to understand how anyone could let a bottom feeding scumbag collection agency extort money from them. Please people, read everything on this website. Thank you Bud Hibbs for sharing your knowledge and expertise in dealing with these criminals.


2007    Bay Area Credit has called us for the last 2 months at least 3-4 per day, some of those have been hang up calls. We just got our new phone number in Jan 2007. Evidentially, the person they are trying to find used to have our number. We have told them this every time we have spoken to them at least 10-12 times. We threatened to complain to Attorney General today and they said they would not call back. Right! We will see. We may file a complaint anyway.


2007    They have been calling my parents house for the past couple months. They never leave a message, finally my father was home when they called. They wouldn't tell him where they were calling from. They just left a number, so I called back. A cell phone bill from 2 1/2 years ago. I tried to explain I do not owe any money, I was told I made a payment in Jan for $120 and the Cell phone companies bill a month behind. Which I understand but I closed the cell phone account dec. 5 So my payment in Jan was the last. I was then told I was being rude. I was talked over the entire time I was on the phone and then hung up on. I decided to call back, not thinking I would get another rude person but sure enough I did. I was told if I didn't pay I would keep getting the phone calls and they would keep damaging my credit. I then told them I would have a lawyer contact them and she proceeded to tell me if I could pay a lawyer then she didn't see why I couldn't pay $49. I told her if I knew what the balance was from and that it was legit then I would pay. She told me she didn't know and to contact TMobile. I asked to not receive any more calls and she hung up on me also. I called tmobile and told them the experience I had with their collection company, they are going to file a complaint. I asked them why I owed this money and was told they could only give me the balance owed that any other questions had to be referred to Bay Area because they had all the information. I refuse to deal with these people. They think if they treat you like crap that you will just fold and pay. I refuse pay any money to a company that belittles people.


2007    I kept getting calls from this company via automated recordings. I would get calls at 9pm Saturday eve, and call right back only to be told their office was closed. When I did hang on the line during one of their daytime calls, I was told via recording how important my call was to them and for me to continue to hold. When the idiot came on the line, he fumbled around trying to tell me why he was calling. When he finally spit the words out of his mouth, I told him in a very polite manner where he could shove his account. I never received anything in the mail from this place so I had no idea where to send a cease communication letter to. A couple of days before Xmas, they call again. They slaughtered my name when trying to ask for me. I told them that no such person lived at this address. The rep then asked what my name was, I proceeded to tell her it was none of her business and what she needed to know was she was calling the wrong person and I wanted it to stop. She then proceeded to ask me why I was being so rude to her. I told her about the constant calls and so forth, and I once again told her to remove my number from their records. She proceeded to talk down to me and told me she would call when she felt like it. She then proceeded to tell me "You just better hope I don't call you on Christmas day." I told her go for it, I wouldn't be home anyway. I have not received a call from them since. Just before I hung up on her, I politely thanked her for being so uncooperative, and notified her the call was recorded. I dared her to call again. Has this place violated consumer law? I thought there was a law that states 5 days after contact, a notice must be sent to the person they are trying to collect from. Am I wrong?


My 70 year old mother has been victimized by these barracuda's for several years now. She has had six heart attacks in the last eight years and this has been devastating for her financially. Every time she has to be taken to the hospital she cries because she knows she will not be able to pay the ambulance ride co-pay and the hospital co-pays, which means one more item added to her many accounts being snatched up by collection agencies, (seems like Bay area Credit Services likes to buy her debts since that is the major collector after her!).

They call her anywhere from eight to twelve times a day. On a day when they feel like really torturing her they have been known to call her and ask her "what is prize for call number 20!" I have sent them Cease Comm letters more than six times in the last three years alone, which they blatantly ignore, even asked me one evening what I planned to do about them violating the FDCP violation?!!

My fourteen year old daughter had enough of watching her grandmother cry several times a day and began answering the phone....she started yelling into the phone like she could not hear who it was on the other end, made up this "person" named "Roger" and hollered into the phone: "Roger?! Is that you Roger?! I can hear you breathing Roger! Stop calling my house Roger! Roger? I know this is you, I can hear you waxing your hairy toe-knuckles Roger, you da** sasquatch!" I know it sounds silly, and all kidding aside it is pathetic that my child has had to turn tables on an entity that she should not even have to know about at 14!
She simply could not take them making her gram cry anymore and came up with this.
It makes me laugh until I cry, because she is so quick witted and the things she says are so random, (like the toe-knuckle waxing thing). Her grandma gets a kick out of it too.

Sorry to ramble but the calls have stopped coming so often...this past week there has been a total of 12 calls...12 in seven days! It went from 8-12 or more per day!

Maybe my kid has made them think there are lunatics in this household and they are getting uncomfortable.
None of them speak English...I asked one of them during a call where she was from because I thought her accent was beautiful, (I told a HUGE lie right at that moment!), and she said New Delhi....I think that was what she said anyway....I said, "Oh, India! That is very far away, it must be hard to work so late at night".

So, yeah they are calling from India.


When Hurricane Rita went through E. Texas my Mother-in-Law was in ICU at a hospital in Beaumont. FEMA evacuated her to Atlanta Georgia and placed her into a hospital there. After a week of searching, I finally tracked her down.

Her medical condition improved enough that she was moved into a nursing home outside of Atlanta where she remained for two weeks before she was well enough to travel again.

Her home in Texas was severely damaged and my Father-in-Law was unable to bring her back to the home until the repairs were made. My Mother-in-Law requires round the clock care, something he was unable to do with no water, no electricity and ¼ of his roof in his neighbor’s yard. On top of that, she has end-stage renal failure and the dialysis center she had been using near her home had lost their roof. My husband and I had no choice but to move her into our home in Florida.

Her medical condition was and still is very bad. Not only does she have end-stage renal failure, she has congestive heart failure, COPD, diabetes and Alzheimer’s. Her care was literally around the clock with me having a crash course in nursing. She has been disabled for almost 4 years now, receives disability, Medicare and Medicaid. But, we’re talking the government, both state and federal, and it took months to get her benefits switched to Texas. In the meantime, her doctors, hospitals, medical supply places, dialysis centers etc did everything they could to get her medical bills taken care of. Not once did my husband or I sign that we were financially responsible for her, only responsible for making medical decisions.

After almost nine months, we were able to get her health to a point where her doctors felt she could be transferred from Fl back to TX. I bought two plane tickets, arranged for her husband to meet us at the airport in Houston with an ambulance and flew back with her.

A month ago, I started receiving phone calls from 408-392-4578; which showed on my caller ID as San Jose, CA, asking to speak to my Mother-in-Law. I explained to the woman who called, who could barely speak English that she no longer lived with us and had not for months. We provided the woman with my Father-in-Laws mailing address and told her to send written communications to him. We thought that was the end to it. WRONG!!!!

Since that day, I’ve received a phone call, every day, from the same number, asking for my Mother-in-Law. A quick internet search showed me that this number was for Bay Area Credit, I found their website, mailing address and sent them a cease and desist letter, certified. I have the card back dated two weeks ago. Still, every day I am receiving a phone call from them. I’ve filed an official complaint with the FTC, Attorney General’s Office’s in Florida and California but have not heard back from any of them yet.

Currently I’m taping each phone call with the intention of showing a full week of phone calls with me telling the same woman she’s violating the cease and desist order. I also inform her she is being taped and she says that’s fine. After 1 week, I will stop answering their phone calls.

If the FTC or the States do nothing to this company and they continue to harass my home, I’ll file a lawsuit against them. Pro Se if needed. In the meantime, I can expect my daily phone call from the same woman, asking the same questions. I’ve asked her what the debt is for since my Mother-in-Law should have no out of pocket medical expense and has not been into a store for at least 3 years. They claim privacy reasons and won’t tell me. Yet, they don’t care about invading my privacy calling my home daily.   This company needs to be put out of business!!!!!
