This man is either a nut or a genius, I’m not sure which.
But here is the direction his scam has taken:
Apothaker is now filing lawsuits in PA on behalf of
Portfolio Recovery Associates, a true marriage made in
heaven. But it gets better. First, Apothaker files a civil
suit (actually under the arbitration division of our civil
court). Then, oddly enough, on the SAME DAY his lawsuit is
filed, a letter is sent from Ferrey & Nicholas, Inc. .
.advising the consumer of the lawsuit (the court papers
haven’t even been served yet), stating that they are a “firm
that negotiates debt”, and that they will contact Apothaker
to try to settle this case out-of-court (for a fee, of
course).
Now, what are the odds that these weasels are in bed with
Apothaker? 100%, maybe? Either they work in the courthouse
and read all of the filings (their letter was dated July
30th, the civil suit was filed dated July 31!), or maybe it
goes something like this:
1. Apothaker files a garbage lawsuit, and sends the case
number to Ferrey & Nicholas
2. Ferrey & Nicholas puts on the “good cop” hat, and offers
to go to bat for the consumer
3. F&N then “negotiates” a pre-determined “settlement”, so
Apothaker gets some cash, F&N gets a fee, and both of them
laugh all the way to the bank!
I am doing some research now to determine if their
notification of F&N constitutes any FDCPA violations, but I
plan to see them in court. . .if they’re willing to drive
all the way across the state for a couple hundred bucks!
April 2009 This firm also does work for Trak America. They were hired through Trak for an old Arrow Financial account. I showed up twice for court and this firm did not show up or have the decency to notify the court. I received a default judgment against them. I have been trying to work with Arrow to have the trade line deleted and they keep telling me, the attorney does not respond to them either. I sent Arrow the transcript from the court Certified mail back in December, but they cannot remove the account from my credit reports until they hear from the attorney.
June 2008 Apothaker & Associates, Philadelphia These company filed a civil suit complaint last year. I filed my answer to the complaint. I also sent a copy requesting proof this debt belong to me. To date, I have not received a hearing date nor any documentation validating this debt. I am going to file complaints with the Pennsylvania Attorney General, the BBB, the FTC and PA Bar.
2007 I am being sued for a loan discharged by the original company under Apothaker saying the company principal place of business is located at 2417 welsh Road suite 21 Philadelphia pa, 19114 . Well this is a PO Box OFFICE. I found two other addresses for them one in phila on Delaware ave. and one in New jersey in mount laurel. I believe the Mount Laurel office is the only real office their phone number is 215-634-8920 and they will give the mount laural address if questioned enough but state the del ave. address is one the lawyers are almost never in and will reluctantly admit that the welsh road address is a po box. I have requested Validation of the loan and filed a statement with the court denying the claim. I have also filed a subpoena for discovery that will be served shortly to have them produce the original contract.
